to tell the thruth phil have been thinking eeexactly what you said, sell up ad buy a second hand working unit then it is a day job..... but i would rather they just got it working and out of my hair!

this is anoptherr option i may face if i recieve a non working car back.

see i have no written quotes but i do have a detailed record kept here on the internet and a verbal contract is still legally bonding, harder to prove but still bonding...

i will see if i receive a phone call later today if not i just hope they have had it runing and sheet and all will be good....

dont worry people i have learned alot from this experiance and things will be different in the future.

thanks
Rhys

P.S phil do you want me to ring you before CA? or the other way round?

Rhys, there is no such thing as Dept of Consumer Affairs in Australia anymore,so dont threaten them with that.I would contact the MVRIA and Dept of Fair Trading and make some enquiries only at this stage, you dont need to lodge a complaint if you dont wish at this stage. Then if the guy doesnt want to play ball, let him know you have started the ball rolling at both these organisations.See what he does.It will probably be the MVRIA that will investigate as Fair Trading do more warranty related complaints.

Phil i thought he should go to www.ocba.sa.gov.au . On their site they say this;

quote:

Lodging a Complaint with Consumer Affairs
Please note: We can only assist with complaints where the goods and services are advertised and purchased in South Australia - for those outside South Australia please refer to your local consumer/business affairs agency.

Before you lodge a complaint with us you need to prove that you have discussed your problem with the trader and that you have written to the trader attempting to resolve the dispute.

To discuss your complaint please telephone one of our Consumer Affairs Officers on (08) 8204 9777 or (for South Australian Country Callers only - excluding mobiles) telephone 131 882.

Once you have lodged a complaint with us, a Consumer Affairs officer will be in contact with you and the trader involved. The officer will try to resolve the dispute through negotiation, conciliation and mediation.

If the dispute cannot be resolved to everyone's satisfaction you may have to take the Matter to court.

That page was last updated 10-8-05, how recently did it change[?]

It could be my mistake.NSW definately dont have a consumer affairs department,it has all changed over to fair trading/cttt/MVRIA for motor vehicle complaints.I would have thought this type of stuff was national, musnt be.

no intention of opening up a can of worms! just have to be carefull i guess when it comes to legal Matters...

most laws to do with consumers are state legislated. NSW is seperate, Vic is too, QLD and Tas use the same, note sure of WA, SA, NT and the ACT

(i work for a finance company in the recoveries/collection/legal side)

grant the 800 is for this:
complete fuel lines

Best of luck mate hope it all works out...

this is the reason i do all my own work... (well i get "professionals" to do the machine work etc and i do the rest..)

some companies can not be trusted or they just dont care.. i know a business has to make money.. but they shouldnt quote if they can not come up with the goods...

hope the rs comes back firing!! at the price of $800 i know how you feel.i have been done several times and i just took it on the chin.. gave me a the drive to get stuck into things myself. and you know with a bit of time and patients and some help from people off the forum or friends you will have everything under control!!

thats the benefits of this site.. when i was putting the cossie in the green Escort... People like Racemap/phil helped me out and i really appreciated it, great advice and help on a Saturday afternoon over the phone.. CHEERS guys..

so Rhys basically all i want to say is once you have the car back get stuck into it if its not running. and work it out you will be fine and it will RUN!![;^)]
