its like what RS said, im over it now ive managed this far with out my car so f@#k it im just gonna sit back, TAFE is too hektic at the moment to get f@#ked around by thos fools[}:)]

yeh mark lunching any motor let alone a f@#kin work of art is devostating......go the snail[;^)][88]

also this has been the nail in the coffin, im doin my own sheet now

just can't wait to have it back......the hills are lookin sooo good right now![:p]

ok people this is the delema, andrew may be able to add some input aswell

Shean rang me today and he explained how we had had some major progress in that the car had been started and all the sensors and fuel pump where up and running and getting readings etc......

all was well to aparen'tly a program that he used stuffed it all up? froxe his comp and wont let him read the ecu again?? andrew can maybe elaborate....

my drama is this

he says he has had enough and that he is loosing to much money/time on my car, he has given me a altimatum

if he cannot fix this issue soon i.e before Sunday he wants me to pay him $850 for the work already put in and take my car incomplete!!

the original price was gonna be $800 and that was f@#king complete!!!running all good!

i need some options, andrew is trying to fix the ecu side of things but i need some help on the legal side of things....

i am not going to pay the whole sum i may pay some but i want to take this further if they want to play like that

if he rings me and wants it gon i will express this and if he says so then i will speak to a lawer....

all i want is my f@#king car back, i was just going to lay low and let em finish it in there own time now, but now he is atacking me it shouldt me my problem if he is having trouble with something i am paying him to solve it....

what do people think? this is a real brief over view of it as the whole story is a 7 week saga i cannot write out

1. The car is causing too much trouble and will haemorrhage cash to a most uncomfortable level.



2. He is actually incompetent and should never have laid a hand on your car in the first place.

he was fully warned about the MS before so if he was unsure of it he should not have taken it on....

he did, stating he has a basic understanding of it as his brother has used a few.....

i trusted in him as he said the above and MS isnt that hard to come to terms with once you get started.

and with point 1 is more his point of view, but could have been everted if he actauly took me serious at the start and did what i said and research the program not leave it till now

Sorry to say mate, but a legal fight you will probably loose. He will blame the MS manufacturer or anything else except him. My opinion is to offer him what you consider is justifiable for the work he has done, but you will most likely find he will stick with his $850.
So pay it and hope he has not f***ed the ECU so either yourself or someone else can work on the car.
This will not be what you want to hear, but I think it will be the cheapest option in the end.
Quotes are only really legally fightable if he supplied and fitted all the parts. When you start sourcing outside parts for a 3rd party to fit, it can get really sticky.

^^ yeh that is eexactly what i have been going thru in my head trying to find a way round it....

the only way i can contest the $850 is that the work done on it is not sufisiant to that quote.....all they done was fuel lines, and a real dodgy loom that isnt fully complete so i hear...

aparen'tly he has a run down of the costs soooo.....

yeh it is a f@#ked situation.....i could work on the approach that if i speak to a lawyer first and make it seem like i have acase they would back down.....just loose ideas that i dont really wanna have to do.....

i still maintain this: all i want is my car back f@#k all the politics!

well we will see what tomorra unvails......im off to try and sleep

Rhys,

Assuming it comes to that (and it hasn't yet, stay positive!) You still have rights, and as far as i know they are breaching them big time (from the small amount of law i've done!).

Arrange a meeting with someone from the consumer protection place www.ocba.sa.gov.au and they will tell you your rights and what to do. DO NOT pay anything until you have spoken to them.

It will come down to whether you or them are in the right. My belief is you will be in the right, you may owe them something but not $850.

As an aside AFAIK they can't legally hold your car against your will.
